1. How refunds work
This Refund Policy is part of our Terms of Service. We sell through Polar Software, Inc. (“Polar”), which acts as our reseller and merchant of record. Polar processes refunds that [COMPANY NAME] LLC approves under this policy, or that are required by law or by card network rules, as described in the Polar Checkout Buyer Terms. Refunds are paid to the original payment method, including the taxes charged on the refunded amount.
2. Source Code Licenses
Source Code is digital content that cannot be returned once it has been delivered. We therefore refund a License Order in full if you ask within [14] days after the purchase and:
- you have not downloaded any Release of the Source Code (we have not issued a download link to you); or
- the Source Code is materially defective or materially different from its description on the product page, and we cannot fix or replace it within a reasonable time after you tell us about the problem; or
- you bought the same License Type for the same Product twice by mistake (we refund the duplicate).
Otherwise, License Orders are not refundable, except where the law requires a refund.
3. Managed Website Subscriptions
- You can cancel a Subscription at any time online from Billing in your Account, which opens the Polar customer portal. Cancellation takes effect at the end of the current Billing Period, and your Managed Website stays available until then. See the automatic renewal section of the Terms of Service.
- We do not refund or credit partial Billing Periods, unused time or downgrades, except:
- under the EU/UK right of withdrawal (Section 4);
- if we cannot set up your Managed Website (full refund);
- if we discontinue the service or materially reduce it during a paid Billing Period, as described in the Terms of Service (prorated refund of the unused time); or
- where the law requires a refund.
- We may grant other refunds at our discretion. A discretionary refund does not create an obligation to grant similar refunds in the future.
4. EU and UK consumers: right of withdrawal
4.1 Your right
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you may withdraw from a purchase within 14 days without giving a reason, subject to the exceptions below.
4.2 Source Code
Source Code is digital content not supplied on a tangible medium. When you buy a License, you ask us to make the Source Code available for download immediately and acknowledge that you lose your right of withdrawal once you download it; this is stated next to the buy button. Where the law requires it, we will also confirm this request and acknowledgment to you by email. Until you download the Source Code, you may still withdraw within 14 days after the purchase, and you can also get a refund under Section 2 (Source Code Licenses).
4.3 Subscriptions
A Subscription is a service. You may withdraw within 14 days after the purchase. Because we set up your Managed Website immediately at your request, we refund the amount you paid minus a proportionate amount for the period during which the site was provided before you told us that you withdraw.
4.4 How to withdraw
Send a clear statement that you withdraw to support@[DOMAIN] before the 14-day period ends. We will arrange the refund through Polar within 14 days after we receive your statement.
5. How to request a refund
Email support@[DOMAIN] from the email address of your Account, with the Order or site concerned and the reason for your request. We review every request and, if it qualifies, ask Polar to issue the refund. The time it takes to appear on your statement depends on your bank or card issuer.
6. What happens after a refund
- License refunds. The License is revoked, its License Key stops working and your download access ends. You must stop using the Source Code and delete your copies, as the License Agreement requires.
- Subscription refunds. A refund of the current Billing Period ends the Subscription and suspends the Managed Website immediately; it is then deleted as described in the Terms of Service. A refund of an earlier Billing Period does not affect the current one.
7. Chargebacks
If you have a problem with a charge, please contact us first; we can usually resolve it quickly. If you file a chargeback for a valid transaction, Polar may contest it with evidence of the purchase and delivery, and we may suspend the related License, Subscription or Account while it is open. If the chargeback succeeds, the License or Subscription ends as it would after a refund. Repeated or fraudulent chargebacks may lead to termination of your Account.
8. Your statutory rights
Nothing in this policy limits rights you have under mandatory consumer protection laws of the place where you live. Where those laws give you a right to a refund, repair or replacement, you keep that right.
